Tax Benefits for Real Estate Improvements - Urban Rehabilitation


The Article 45 of the EBF (Tax Benefits Statute) continues to provide access to tax exemptions on IMT (Municipal Tax on Transactions) and IMI (Property tax) in cases of Urban Rehabilitation, but there have been significant changes to its text in recent years, which have made its scope more restricted.

Its object is now limited to the verification of the following cumulative conditions:
  • Intervention on an urban building or autonomous fraction with more than 30 years or located in urban rehabilitation areas;
  • The property has been subject to a rehabilitation intervention promoted under the terms of the Legal Regime for Urban Rehabilitation;
  • The conservation status is two levels above the pre-intervention state and has at least a good level under the terms of the applicable legislation - Decree-Law no. 266-B / 2012, of 12/31 and its amendments;
  • The requirements for energy efficiency and thermal quality are complied under the terms of the applicable legislation, in particular the Decree-Law No. 118/2013, of 20/08, and its amendments.

Having fulfilled the requirements listed above, the main benefits granted are:

  • Exemption from IMI for a period of 3 years, from the year of the completion of the rehabilitation works, which can be renewed, by request of the owner, for an additional 5 years in the case of properties leased or used for permanent housing;
  • Exemption from IMT on the acquisition, provided that the acquirer starts the respective works within a maximum period of 3 years from the acquisition date;
  • Exemption from IMT in the first transmission, subsequent to the rehabilitation intervention, when destined to lease for permanent housing or, when located in an urban rehabilitation area, also for own permanent housing;

The mentioned exemptions are granted after the collection of the respective taxes, so they are always given as a refund.

According to the most recent legislative amendment - Law no. 114/2017, of 12/29 - the recognition of the rehabilitation intervention must be requested with the previous communication or with the licensing request to the competent city council, being the responsibility of the city council (or if applicable, the managing entity of the urban rehabilitation) to communicate this recognition to the Tax Authority department of the area of the property.

This communication is made within a maximum period of 20 days from the date of the determination of the state of conservation resulting from the works, or from the issue of the respective energy certification, if later.

The effective refund of the taxes paid must be made by the Tax Authority services within a maximum period of 15 days from the communication referred to above.

Industries and activities that require VAT registration in Portugal


When carrying out trading activities in portuguese territory, foreign companies must be aware of their VAT registration and compliance obligations.
These are the most common ativities that require VAT registration in Portugal:


EVENT ORGANIZERS
Organizers of exhibitions, conferences, seminars and other events in Portuguese territory are required to be VAT registered, and file the VAT Returns periodically if it is a continuous activity, or a single VAT return in reference to the period of the event. Related costs are recoverable subject to the normal rules of deduction.

E-COMMERCE
Online sales to individuals or non-registered entities in Portugal will require the vendor to register for VAT, once the annual threshold of 35.000€ has been exceeded. The VAT on sales will then be charged at the portuguese rates, and the VAT Returns must be filed and paid periodically.

EXPORTERS - WAREHOUSE REGIME / CONSIGNMENT PROGRAMS
When exporters send their goods to Portugal to create a consignment stock to supply customers or goods subject to a Customs warehousing regime, they are required to be VAT registered. When the stock is kept by the clients, the sales may be processed through SBI (self billing invoice) by the client in a certified software, or alternatively, the company must have a certified software to issue the invoices. VAT Returns must be filed and paid periodically.

SUPPLY AND INSTALL CONTRACTORS
Contractors, who supply goods for which they are also responsible for the installation in portuguese territory, may be required to register for VAT. If the clients in Portugal are VAT registered entities, they will be able to declare the VAT on behalf of the foreign contractor, but if the clients are individuals or non-registered entities, the VAT registration is required, as the filing and payment of a VAT Return.

Tax Id Number in Portugal (NIF) for foreign companies

To request the Tax Id Number (NIF or NIPC) of a foreign company in order to develop an activity in Portugal, or of a foreign entity with no activity in Portugal, the entity must be identified in the Central File of Legal Persons, upon issuance by the RNPC of a certificate containing the identification number, company name, nationality, and mention of the purpose of the isolated act or activity to be practiced in Portugal.

The following documents will be required:

  • Application form - for registration / identification of legal entity or similar entity duly filled and signed by the person who represents the entity, lawyer or solicitor, except if the request is made in person in the RNPC by the company Director or by a person with legitimacy;
  • Identification of the fiscal representative for tax purposes (natural or legal person, resident in Portugal), in accordance with the article 19, paragraph 6, of Decree-Law no. 398/98 of December 17, except in the case of entities established in a country of the European Union;
  • Proof of the legal existence of the entity in the country of origin (duly updated if it is an entity subject to registration) within the validity period, issued by the competent services; and proof of the position or quality of the subscriber of the application, accompanied by the respective translation, made by a person entitled to do so, unless the documents are in English, French or Spanish; It is not accepted as proof of legal existence documents printed from the Internet, unless it is assigned legal value by national legislation.
  • Copy of the identification document of the applicant;
  • Payment in the amount of € 50 (cost of registration).

The company's NIPC request may also be made without the presence of the director or manager of the company, and may be requested directly by the tax representative or someone appointed for this purpose.

Abertura de Sucursal em Portugal

Para abrir uma sucursal em Portugal de uma empresa estrangeira, o processo deverá ser tratado por alguém com legitimidade para representar a empresa, bem como o futuro representante da sucursal a criar em Portugal. Poderão também ser representados por alguém com procuração para o efeito. 

Os documentos necessários para a abertura de sucursal em Portugal, serão os seguintes:
  1. Documento de identificação do interessado/requerente (passaporte);
  2. Documento comprovativo da sua legitimidade (como sócio-gerente da empresa);
  3. Documento comprovativo da existência jurídica da entidade que cria a representação permanente;
  4. Texto completo e actualizado do pacto social ou dos estatutos da entidade que cria a representação permanente;
  5. Deliberações sociais da empresa, que aprovam a criação da representação permanente e a designação do(s) respectivo(s) representante(s);
  6. Número de identificação fiscal português do(s) representante(s) da representação permanente.
Os documentos originais da empresa emitidos no estrangeiro, devem ser reconhecidos por agente diplomático ou consular português no Estado respectivo, com assinatura autenticada com o selo branco.
Os documentos escritos em língua estrangeira devem ser acompanhados da tradução correspondente (com excepção de quando estiverem redigidos em língua Inglesa, Francesa ou Espanhola e o funcionário dominar essa língua) podendo ser exigida pelos serviços a sua legalização.

Caso o representante da sucursal em Portugal seja estrangeiro e não possua NIF, deverá obter o seu número de contribuinte antes da abertura da sucursal. Pode consultar como neste artigo.

Será também solicitada informação do endereço da sucursal em Portugal, pois uma representação permanente em Portugal exige sempre um endereço fixo. Caso não disponha de instalações fisicas, poderá usar um serviço de endereço virtual para a sua empresa, o qual também disponibilizamos aqui.

A firma ou denominação da sucursal em Portugal, será o nome da empresa-mãe seguido da designação "Sucursal em Portugal", "Representação Permanente em Portugal", ou algo semelhante.

A sucursal deverá dispor de contabilidade organizada, necessitando por isso dos serviços de um Contabilista Certificado, serviço o qual também prestamos. Poderá indicar o Contabilista Certificado imediatamente na constituição da sucursal, ficando de imediato registado como tal e permitindo assim que a declaração de Inicio de Atividade seja já entregue nas Finanças por via eletrónica.

Contabilisticamente, os movimentos da sucursal portuguesa deverão ser refletidos na sua própria contabilidade e deverão posteriormente ser refletidos na contabilidade da sede. No entanto, dado que os lucros obtidos em Portugal deverão obrigatoriamente pagar imposto cá, estarão isentos ou serão deduzidos à tributação no país da sede (dependendo da convenção para evitar dupla tributação entre Portugal e o país em causa).
A taxa de IRC a pagar sobre o lucro contabilístico obtido em Portugal é de 17% até 15.000€ de lucro anual, e de 21% para lucros superiores (aplicando-se 17% aos primeiros 15.000,00€ e 21% ao restante).

No entanto, no que se refere aos movimentos de capitais da sucursal (e respetivos lucros), existe livre transferência de capitais da sucursal para a sede, sem qualquer tributação ou retenção de impostos.

Pedido de NIF de empresa estrangeira em Portugal


Para pedir o NIPC / NIF de uma empresa estrangeira a desenvolver atividade em Portugal, ou uma entidade estrangeira sem atividade em Portugal, a entidade deverá ser identificada no Ficheiro Central de Pessoas Coletivas, mediante a emissão pelo RNPC de certidão, contendo o número de identificação, firma, nacionalidade, e menção da finalidade, do ato isolado ou atividade a praticar em Portugal.

Serão necessários os seguintes documentos:
  • Formulário próprio, (Modelo 2 - Pedido de inscrição/identificação de pessoa coletiva ou entidade equiparada) devidamente preenchido e assinado por quem represente a entidade, advogado ou solicitador, exceto se o pedido for formulado presencialmente, no RNPC, de forma verbal, pelo próprio ou por pessoa com legitimidade ou pela Internet;
  • Identificação do representante para efeitos tributários (Pessoa singular ou coletiva, residente em Portugal), por força e ao abrigo do disposto no nº 6 do artº 19º do decreto-lei nº 398/98 de 17/12, exceto se se tratar de Entidade Equiparada Estrangeira, com sede em país da União Europeia ou no Espaço Económico Europeu, neste último caso desde que esse Estado esteja vinculado a cooperação administrativa no domínio da fiscalidade equivalente à estabelecida no âmbito da União Europeia;
  • Comprovativo da existência jurídica da entidade no país de origem, (devidamente atualizado caso se trate de entidade sujeita a registo) dentro do prazo de validade, emitido pelos serviços competentes e de documento comprovativo do cargo ou qualidade do subscritor do pedido, acompanhados da respetiva tradução, efetuada por quem tenha legitimidade para o efeito, salvo se os documentos se encontrarem redigidos em língua inglesa, francesa ou espanhola; Não é aceite como comprovativo da existência jurídica, documento retirado da Internet, atendendo ao facto de o seu valor ser meramente informativo, exceto se ao mesmo for atribuído valor legal pela legislação nacional.
  • Fotocópia do documento de identificação (ou a aposição do carimbo junto da assinatura) caso o mesmo se apresente assinado por advogado ou solicitador;
  • Pagamento emolumentar de 50€.

O pedido de NIF da empresa pode também ser efetuado à distância, sem a presença do gerente ou administrador da empresa, podendo ser requerido diretamente pelo seu representante fiscal ou alguém a indicar
 para este efeito.

Estatuto de Residente Não Habitual

Para os cidadãos que estejam fora do país e queiram vir morar em Portugal, estrangeiros ou de nacionalidade portuguesa, existe um regime fiscal especial, o Estatuto de Residente Não Habitual.

Vantagens:
  • A tributação, durante um período de 10 anos, a uma taxa fixa de IRS de 20% sobre os rendimentos do trabalho auferidos em Portugal (atividades de elevado valor acrescentado, sejam elas de caráter científico, artístico ou técnico);
  • A inexistência de dupla tributação, no caso das pensões e do trabalho dependente e independente auferido no estrangeiro.


Como adquirir o Estatuto de Residente Não Habitual:
  1. Não ter sido residente em Portugal nos últimos 5 anos;
  2. Registar-se como residente fiscal em Portugal no Serviço local de Finanças (para tal deverá ter permanecido em Portugal mais de 183 dias, seguidos ou interpolados, ou tendo permanecido por menos tempo, aí disponha, em 31 de dezembro desse ano, de habitação em condições que façam supor a intenção de a manter e ocupar como residência habitual);
  3. Solicitar a atribuição do estatuto de Residente Não Habitual no momento em que se inscreve como residente fiscal em Portugal ou até 31 de março do ano seguinte àquele em que se torne residente em Portugal.

Descrição do Benefício Fiscal

A tributação especial ao abrigo deste regime, é válida por um período de 10 anos, a uma taxa fixa de
IRS de 20% (a que acresce a sobretaxa de 3.5%) 
e incide sobre os rendimentos de trabalho dependente
ou independente, decorrentes de atividades de elevado valor acrescentado com carácter científico,
artístico ou técnico, como são:
  • Arquitetos, engenheiros e similares
  • Artistas plásticos, atores e músicos
  • Auditores
  • Médicos e dentistas, professores e psicólogos
  • Profissões liberais, técnicos e assimilados
  • Quadros superiores
  • Investidores, administradores e gestores, quando integrados em empresas que tenham sido abrangidas
    pelo regime contratual previsto no Código Fiscal do Investimento.
Já no caso de ser tratar de um contribuinte com rendimentos de trabalho dependente e independente que sejam
obtidos no estrangeiro, aplica-se o método da isenção da tributação em Portugal. Ou seja: não pagam imposto
cá, desde que sejam tributados noutro país ou se estiverem cumpridos outros critérios previstos na lei.
No caso de o contribuinte ser um pensionista estrangeiro que receba a sua pensão através de outro país aplica-se
o mesmo princípio da isenção da tributação em Portugal, desde que seja cumprido um dos requisitos exigidos
(Ex: sejam tributados no outro Estado contratante, em conformidade com convenção para eliminar a dupla tributação,
ou quando pelos critérios previstos no n.º 1 do art.º 18.º do CIRS não sejam de considerar obtidos em território
português).

VISA D2 - Portuguese Residence Visa for Self Employed Professional Activity or Immigrant Entrepreneurs

The request of Residence Visa to exercise independent professional activity or immigrant entrepreneurs (visa D2) should normally be made by the applicant in his country of residence, on a Portuguese Embassy or Consulate.

The deadline for the decision is usually 60 days, counted from the day of submission of the application, duly submitted, with all the documentation mentioned below. This period may vary depending on the country of origin.

In many cases, foreigners enter Portugal with a Tourist Visa, and during their Visa term and a possible extension, treat their application for a residence permit already in Portugal, with the SEF (Foreigners and Borders Service) and starting the business or activity simultaneously. In other cases, they use the tourist visa period to analyze and deal the investment directly in Portugal, and then return to their home country with all the documentation to request a residence Visa D2.

How to apply?

The following documents are usually required:

  • Visa Application Form (model at the Embassy of Portugal or SEF);
  • Passport valid for more than 3 months beyond the planned departure date (original and 1 copy);
  • 1 photo, size 3 x 4 cm, color and plain background, updated and in good conditions to atest the applicant's identification;
  • Criminal record certificate, issued less than three months, the country of origin or where the applicant has lived for more than a year, authenticated by the respective Ministry of Foreign Affairs;
  • Medical insurance, which covers any expenses required for medical reasons, including urgent medical assistance and possible repatriation (original);
  • Application for Portuguese Criminal Record query by SEF (original);
  • Proof of accommodation conditions (original);
  • Proof of means of subsistence (original);
  • Independent professional activity:
    • Contract for services with a company or Contract/Proposal for services with clients (original);
    • When applicable, a statement issued by the competent authority for verification of the profession exercise requirements that, in Portugal, it is subject to special qualifications.
  • Immigrant entrepreneurs:
    • Declaration that you made or intends to carry out an investment operation in Portugal, indicating their nature, value and duration (original);
    • Proof that you made investment operations (original); or
    • Proof that you have funds available in Portugal, including those obtained from any financial institution in Portugal, and the intention to carry out an investment operation in Portuguese territory, properly described and identified (original).

Fiscal Representation in Portugal - Representation in IRS and VAT


The obligation to appoint a Fiscal Representative on IRS (Individuals)
Defined in the Individuals Income Tax Code (IRS) in Article 130, it is mandatory to appoint a Tax Representative whenever a person without residence in Portugal, or that while living in the country is absent for a period exceeding six months, get's income in Portugal subject to tax, or that for any other reason wishes to have the Portuguese Taxpayer Id Number (NIF).
It is also a legal requirement that all non-residents wishing to purchase a property in Portugal, or hold any assets, appoint a Tax Representative. The Fiscal Representative is legally responsible for receiving their fees, property taxes, inform the taxpayer of all tax obligations, and ensure that payment is made within the designated time limits.

The obligation to appoint a Fiscal Representative on VAT (Individuals and Companies with activity)
Defined in the Tax Value Added Code (CIVA) in Article 30, non-residents (individual or collective) without a permanent establishment in Portugal, that here practice taxable transactions in VAT, are required to appoint a Tax Representative who is also a registered subject of VAT tax.
Also all foreign citizens wishing to start an activity on their own (self-employed), will be required to appoint a Tax Representative for VAT, which is himself a taxable person for VAT. This applies even if you don't exceed the VAT exemption limit of CIVA Article 53 (10.000€ annual), since you practice taxable VAT transactions even being momentarily exempt.
The Fiscal Representative must have a power of attorney with sufficient powers to do so, and must comply with all VAT obligations, including registration, and is liable for the tax shown in debt, for the transactions carried out by the foreign company or indicidual. For this reason, this type of representation has increased responsibility for the representative. This requirement is optional for individuals or companies with headquarters or permanent establishment in an EU Member State.

Consequences of not appointing a Fiscal Representative
In addition to the consequences that may result from not receiving the communications from the Tax Authority, with the failure to designate a Tax Representative, the taxpayer whether individual or collective, incurs in a tax offense subject to the payment of a fine from €50.00 to €5,000.00.

Tax Id Number in Portugal or NIF for foreign citizens

If you are a foreign citizen, and for any reason need to apply for the Taxpayer Identification Number in Portugal (NIF as called in Portugal), you can do it at any Tax Authorities office in Portugal, as follows:

1) If you are national or resident of a European Union country or have dual-citizenship, simply present your ID national european citizen Card, and proof of address of your residence in Europe.

2) If you are from a country outside the European Union, you need to appoint a Fiscal Representative in Portugal, who should be a Portuguese citizen or have a permanent residence authorization in Portugal. Since April 2016 the temporary residence holders can not be tax representatives. Your tax representative must present his ID or Portuguese Citizen Card or Permanent Residence Card, and his Taxpayer Number. You just need to show your passport, and a proof of your address in your origin country. You must also have the stamp in the passport of entry in the country. If you entered through an uncontrolled border, you need to go to the SEF office in 3 days to register your entry.

Your tax address will be aggregated to your fiscal representative, to whom will be send your password to access the Tax Authority Portal, and all correspondence from the Portuguese Tax Authorities. He is also responsible for ensuring compliance with all your tax obligations. If you later obtain a residence authorization, you then can disaggregate the representative.

The Tax Id Number (NIF) is assigned immediately when requested, being provided immediately a taxpayer registration document, with your official Number.

You can also apply for the Tax Id Number (NIF) even not being in Portugal. The request should be made directly by your tax representative in Portugal. and it's necessary for that a certified copy of the passport and a specific power of attorney for this purpose.

A obrigação de nomeação de Representante Fiscal em IRS (Pessoas Singulares)
Definido no Código do Imposto sobre o Rendimento das Pessoas Singulares (IRS) no artigo 130º, é obrigatório nomear representante fiscal em Portugal sempre que uma pessoa sem residência em Portugal, ou que, embora residentes em território nacional se ausentem deste por um período superior a seis meses, obtenha rendimentos em Portugal sujeitos a imposto, ou que por qualquer outro motivo pretendam obter o Número de Contribuinte ou de Identificação Fiscal (NIF).
É também um requisito legal de que todos os não residentes que pretendam adquirir uma propriedade em Portugalou deter qualquer tipo de ativos, nomeiem um representante fiscal em Portugal. O seu representante fiscal é legalmente responsável por informar o contribuinte sobre as suas taxas e impostos sobre a propriedade, assegurar o contacto com a Administração fiscal, informar o contribuinte de todas as obrigações fiscais, e assegurar-se de que o pagamento é feito dentro dos prazos limites designados. 


A obrigação de nomeação de Representante Fiscal em IVA (Pessoas Singulares e Coletivas)
Definido no Código do Imposto sobre o Valor Acrescentado (CIVA) no artigo 30º, os não residentes (singulares ou coletivos) sem estabelecimento estável em Portugal, e que aqui pratiquem operações tributáveis em IVA, são obrigados a nomear um representante fiscal em Portugal que também seja sujeito passivo do imposto.
Assim, também todos os cidadãos estrangeiros, que pretendam iniciar uma atividade por conta própria (trabalhador independente), serão obrigados a nomear um representante fiscal em IVA, que seja também ele um sujeito passivo de IVA. Isto aplica-se mesmo que não ultrapasse o limite de isenção de IVA do artigo 53º do CIVA, dado que pratica operações tributáveis em IVA mesmo estando momentaneamente isento.
O representante fiscal deverá ter uma procuração com poderes bastantes para tal, e deverá cumprir todas as obrigações do IVA, incluindo a do registo, e é devedor do imposto que se mostre devido pelas operações realizadas pelo representado. Por este motivo, este tipo de representação apresenta uma responsabilidade acrescida para o representante. Esta obrigação é facultativa para singulares ou empresas com sede ou estabelecimento estável num Estado membro da UE.


Consequências da falta de nomeação de Representante Fiscal em Portugal
Além das consequências que possam resultar pelo facto de não receber as comunicações da Autoridade Tributária, na falta de designação de representante fiscal, o sujeito passivo, quer se trate de pessoa singular, quer coletiva, incorre em contra-ordenação fiscal, sujeitando-se ao pagamento de uma coima de € 50,00 a € 5.000,00.

Informações fiscais:

As obrigações fiscais dos indivíduos não residentes, que pretendam comprar uma casa em Portugal, são:
  • Requerer número de contribuinte (NIF), através de um representante fiscal;
  • Entrega e pagamento de I.M.T. (Imposto Municipal sobre Transmissões) no momento da compra;
  • Pagamento anual do I.M.I. (Imposto Municipal sobre Imóveis);
  • No caso de existirem rendimentos, proceder à entrega da declaração anual de rendimentos (IRS);
  • Em caso de proceder à venda do imóvel, declarar e pagar imposto sobre as mais valias (se existirem).


Cessação / Encerramento de Atividade em IVA


  Vantagens   

A cessação da atividade em IVA:
  • Põe fim à obrigação de entrega da Declaração Periódica de IVA;
  • Dispensa a empresa do pagamento especial por conta (PEC);
  • Põe fim à obrigação de remuneração do gerente e pagamento das respectivas contribuições para a Segurança Social.

  Condições e Obrigações  

Não basta simplesmente não exercer atividade, ou não praticar operações tributáveis (incluindo-se também as operações isentas sem direito à dedução) para poder cessar a atividade em IVA. É também obrigatório que à data da cessação, não tenha qualquer património ou existências, cujo IVA tenha deduzido na aquisição.
O art. 34.º do Código do IVA define o conceito de cessação de atividade, resumindo-se às seguintes situações
a) Deixem de praticar-se actos relacionados com actividades determinantes da tributação durante um período de dois anos consecutivos, caso em que se presumem transmitidos, nos termos da alínea f) do n.º 3 do artigo 3.º, os bens a essa data existentes no activo da empresa;
b) Se esgote o activo da empresa, pela venda dos bens que o constituem ou pela sua afectação a uso próprio do titular, do pessoal ou, em geral, a fins alheios à mesma, bem como pela sua transmissão gratuita;
c) Seja partilhada a herança indivisa de que façam parte o estabelecimento ou os bens afectos ao exercício da actividade;
d) Se dê a transferência, a qualquer outro título, da propriedade do estabelecimento.
Na alinea a) relativa aos casos em que deixem de se praticar atos durante um período de dois anos consecutivos, é preciso ter em conta que se presumem transmitidos os bens a essa data existentes no ativo da empresa, nos termos da alínea f) do n.º 3 do artigo 3.º, que nos diz o seguinte:
3 - Consideram-se ainda transmissões de bens, nos termos do n.º 1 deste artigo: 
f) Ressalvado o disposto no artigo 26.º, a afectação permanente de bens da empresa, a uso próprio do seu titular, do pessoal, ou em geral a fins alheios à mesma, bem como a sua transmissão gratuita, quando, relativamente a esses bens ou aos elementos que os constituem, tenha havido dedução total ou parcial do imposto; 
Ou seja, se o sujeito passivo pretender cessar atividade por não ter praticado atos tributáveis (incluindo operações isentas) durante dois anos, no caso de possuir património ou existências que tenha deduzido IVA, então terá que liquidar o IVA sobre tal património existente.
Pode então existir, em consequência da cessação, um valor de imposto a entregar ao Estado.

Todas as entidades inscritas em IVA são obrigadas aos termos desta legislação, independentemente de ser empresa ou independente, ou de estar no regime simplificado ou de contabilidade organizada. Obviamente o apuramento é mais dificil nos casos de regime simplificado, dado que não existe um registo obrigatório dos inventários, no entanto é possivel confirmar todo o IVA deduzido em compras e imobilizado, através da consulta das declarações periódicas.

A grande diferença entre as sociedades e os sujeitos passivos singulares é que um empresário em nome individual ou um trabalhador independente pode simplesmente dar destino ao património afeto à atividade pela mera imputação à sua esfera pessoal. Nas pessoas coletivas a situação que mais se aproxima desta imputação, mas que ainda assim é distinta, é a partilha dos bens pelos sócios findo o processo de liquidação, sendo que a regra é que os bens sejam vendidos a terceiros.


  Desvantagens  

Antes de mais, convém que os apuramentos finais do IVA sejam bem efetuados, porque depois de cessada a atividade, mesmo que reinicie, não poderá fazer regularizações referentes à atividade anteriormente cessada.

Nos casos em que posteriormente se retoma a atividade, entregando uma declaração de início/reinício, no caso de vender os bens que ficaram aquando da anterior cessação, existe uma transmissão de bens tributável em IVA e não há nenhuma norma que isente a operação ou que permita a dedução do IVA liquidado aquando da cessação. Há aqui uma dupla tributação do imposto.

Além disso, ainda que o sujeito passivo não disponha de bens à data de cessação pode ter créditos a receber. Uma cessação em IVA prematura pode impossibilitá-lo de regularizar, a seu favor, o IVA dos créditos considerados incobráveis, nomeadamente em caso de insolvência declarada dos devedores.

Anexo SS - Quem tem que entregar?

Todos os trabalhadores independentes têm de entregar o Anexo SS, ou seja, desde que tenha atividade aberta, terá que entregar este anexo.
Assim, mesmo que seja simultaneamente trabalhador dependente (por conta de outrem) e por isso esteja isento do pagamento de contribuições para a Segurança Social, terá ainda assim que entregar o Anexo SS (estando dispensado de preencher o campo 6 do mesmo). E esta regra foi introduzida no ano passado e mantém-se este ano.
Acontece o mesmo, se acumular a sua atividade com rendimentos de pensões de invalidez ou de velhice.
Estão ainda obrigados os trabalhadores independentes que nunca tenham atingido rendimentos superiores a 2.515,32 euros (6 Indexantes de Apoios Sociais).

As situações em que este Anexo é totalmente dispensado, é o caso dos advogados e solicitadores integrados obrigatoriamente na respetiva Caixa de Previdência, ou os trabalhadores que exerçam em Portugal atividade de caráter temporário e que estejam a descontar para um regime de proteção social de outro país.
